The Constitution of 2011

The supreme text. We read it for you: the articles on parties (7, 9, 29), the opposition (10, 60), elections (2, 11, 30, 47, 61, 62), participation, youth and parity, and the territorial councils (135 to 146).

What the Constitution says about our party

The rules in brief

A short reading aid, not a legal opinion. Only the official texts apply.

Joining a party (organic law 29.11)

  • Any citizen aged 18 or more may join freely a party that was lawfully founded (article 19).
  • Nobody may belong to more than one party at the same time (article 21).
  • A member may withdraw at any time, following the procedure in the party's statutes (article 22).
  • Members of the armed forces and the public force, magistrates, officials of the authority and others named in article 23 may not join.
  • The financial resources of a party include the members' subscription (article 31).

Standing as a candidate (organic law 59.11)

  • A candidate must be a voter and enjoy their civil and political rights (article 4).
  • Some people cannot stand: recently naturalised persons, people removed from an elected office by a final decision, people who no longer meet the conditions to vote, some officials in office or who left it less than a year before the vote, and people convicted as the law specifies (article 6).
  • The file includes signed and certified declarations, a photograph, a certificate of registration on the electoral roll, a criminal record extract issued less than three months before, and the party's endorsement (article 7).
  • Nobody may stand in more than one constituency or on more than one list, and a list may not mix members of different parties, except lists of registered coalitions (article 8).

Campaign conduct (organic law 59.11)

  • Giving or promising gifts, donations or benefits to influence a vote is punished by one to five years in prison and a fine of 50,000 to 100,000 dirhams (articles 65 to 67).
  • Spreading false news or rumours to divert votes or to make voters stay at home is punished (article 54).
  • Threats, violence and disorder around the vote are punished (articles 56 to 59).
  • Phones and cameras are forbidden inside the room of a polling office (article 53).
